1. Service Agreement & Acceptance
These Terms of Service ("Terms") constitute a binding agreement between you ("Customer," "you," or "Client") and GymHubs ("Company," "we," "us," or "our"), a registered community fitness hub provider based in Sangini Complex, Chimanlal Girdharlal Rd, Ellisbridge, Ahmedabad 380009, India. By engaging with GymHubs for equipment consultation, quotation preparation, equipment supply, installation services, or any other service we offer, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Scope of Services
GymHubs provides comprehensive gym equipment and fitness services. Our services include expert consultation, detailed equipment quotations, equipment supply and procurement from verified manufacturers, professional installation and setup, and ongoing technical support.
3. Service Limitations & Disclaimers
Equipment Performance Disclaimer: While GymHubs supplies quality equipment from verified manufacturers, we do not guarantee specific fitness results, performance outcomes, or durability beyond the manufacturer's warranty period. Equipment performance depends on proper usage, regular maintenance, environmental conditions, and individual fitness levels. Fitness results vary significantly based on user effort, diet, recovery, training consistency, and individual physiology—factors entirely outside GymHubs's control.
Response Time Disclaimer: While GymHubs strives to provide prompt responses to enquiries and support requests, we do not guarantee specific response times. Response times may vary based on workload, complexity of requests, and availability of our team.
Installation Timeline Disclaimer: Installation timelines provided in quotations are estimates based on typical conditions. Actual installation timelines may vary due to site-specific challenges, equipment availability delays, logistics issues, weather conditions, or unforeseen circumstances. GymHubs will make reasonable efforts to meet estimated timelines but does not guarantee specific installation dates.
4. Quotation & Pricing Terms
All quotations provided by GymHubs are valid for 30 days from the date of issuance unless otherwise stated. Quotations are based on information provided by you and are subject to change if your requirements change or if final site assessment reveals different conditions than initially assessed.
Pricing includes equipment costs, basic installation labor, and standard delivery to your location. Additional charges may apply for complex installations, extended delivery distances, special equipment handling, or additional services requested after quotation issuance. All prices are in Indian Rupees (INR) and exclude applicable GST unless stated otherwise in the quotation.
5. Order Acceptance & Cancellation
Your order is confirmed upon receipt of your written acceptance of the quotation and receipt of the advance payment. Once confirmed, orders are subject to the following cancellation terms:
Cancellation within 7 days: Full refund of advance payment minus 10% administrative fee.
Cancellation after 7 days but before procurement: Full refund of advance payment minus 20% administrative fee.
Cancellation after procurement: Refund minus actual costs incurred.
Cancellation after delivery: No refund of advance payment. Equipment may be returned within 30 days for 80% refund of equipment cost.
6. Installation & Site Requirements
Your gym location must have adequate space for equipment placement as specified in the gym layout plan. The installation site must have proper electrical supply, adequate ventilation, and appropriate flooring. You must provide safe access to the installation site and ensure the area is clear of obstructions during installation dates.
You are responsible for any structural modifications, electrical upgrades, or site preparation required to accommodate the equipment. GymHubs installation services do not include structural modifications or major site preparation.
7. Warranty & After-Sales Support
All equipment supplied by GymHubs comes with the original manufacturer's warranty, typically ranging from 1 to 3 years depending on equipment type. Warranty covers manufacturing defects and equipment failures under normal usage conditions. Warranty does not cover damage from misuse, improper maintenance, accidental damage, or normal wear and tear.
8. Payment & Financial Terms
Payment for GymHubs services must be made according to the payment schedule specified in your quotation. Accepted payment methods include bank transfer, cheque, credit card, and digital payment platforms. If payment is not received by the due date, GymHubs reserves the right to suspend services, delay delivery, or cancel the order.
9. Liability Limitations
To the maximum extent permitted by law, GymHubs's liability for any claims arising from our services is limited to the total amount paid by you for the specific service in question. GymHubs is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, or business interruption.
GymHubs is not responsible for injuries, accidents, or property damage that may occur during or after equipment use. Users of gym equipment assume all risks associated with equipment use.
10. Dispute Resolution & Governing Law
These Terms are governed by the laws of India, specifically the laws applicable in Gujarat. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of courts in Ahmedabad, Gujarat.
